Welcome to Homestay.Network. These Terms and Conditions ("Terms") govern your access to and use of the Homestay.Network website, applications, and services (collectively, the "Platform"). By using the Platform, you agree to be bound by these Terms.

1. Scope of Services

Homestay.Network is an online marketplace that enables registered users ("Members") to publish listings for accommodations ("Listings") and to communicate and transact directly with Members who are seeking to book such accommodations ("Guests"). Homestay.Network is not an owner, operator, or provider of any Listings, and we are not a party to the contracts entered into directly between Hosts and Guests.

2. Account Registration

You must register an account to access and use many features of the Platform. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your password and for any activities or actions under your account.

3. Host Terms

As a Host, you are responsible for your own acts and omissions. You must provide accurate information about your Listing, including a truthful description, current pricing, and availability. You are responsible for setting your price and establishing rules for your Listing. You represent and warrant that any Listing you post will not breach any agreements you have with third parties and will be in compliance with all applicable laws.

4. Guest Terms

As a Guest, you are responsible for leaving the accommodation in the condition it was in when you arrived. You are responsible for your own acts and omissions and are also responsible for the acts and omissions of any individuals whom you invite to, or provide access to, the accommodation.

5. Bookings, Payments, and Fees

When a Guest requests a booking, a legally binding agreement is formed between the Guest and the Host upon the Host's acceptance of the booking request. Homestay.Network charges service fees to both Guests and Hosts in consideration for the use of the Platform. All applicable fees, including the Listing Fee, Guest Fee, and any applicable Taxes, will be disclosed to you prior to booking or listing a property. All payments are processed through a secure third-party payment provider.

6. Cancellations and Refunds

All cancellations and any resulting refunds are governed by our Refund Policy. Please review it carefully to understand your rights and obligations.

7. Prohibited Activities

You agree not to use the Platform for any unlawful purpose or to engage in any conduct that is fraudulent, discriminatory, or could damage, disable, or impair the service. This includes, but is not limited to, creating false accounts, posting inaccurate information, or contacting other Members for any purpose other than asking a question related to a booking or listing.

8. Limitation of Liability

The Platform is provided "as is" without warranty of any kind. We are not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our services, including but not limited to damages from interactions between users.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Mumbai, Maharashtra, India, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.
